In September of 2024, a U.S. judge ruled that the U.S. Department of Transportation’s consideration of race or gender when awarding federal highway and transit project funding set asides for disadvantaged small businesses is unconstitutional.
In granting the request for preliminary injunction made by the Mid-American Milling Company, LLC and Bagshaw Trucking Inc., the U.S. District Court in Frankfort, Kentucky, held that the federal DBE program that treats businesses owned by racial minorities and women as presumptively disadvantaged and eligible for such funding violated the U.S. Constitution’s equal protection guarantees.
As a result of this litigation, 25 states have reduced most of their DBE goals to ZERO!

We are 100% volunteer driven, and dedicated to advocating for the preservation of DBE programs, ensuring protection of America’s founding principles of free market and capitalism which are integral to our country’s economic development and growth. Through strategic partnerships, education, and advocacy, we strive to empower DBEs to thrive in a competitive marketplace, driving economic growth and social equity.
